Litigation:

We represent clients in litigation and arbitrations involving all types of business disputes and have successfully litigated or arbitrated claims for breach of contract, fraud, civil theft, negligence, negligent misrepresentation, conversion, and violation of Colorado’s Consumer Protection Act. We have been particularly active and successful in litigating and arbitrating claims against a Colorado company named General Steel Corporation based on business practices used in selling consumers steel buildings [please see links below]. We also represent clients in construction and real estate litigation, including breach of real estate and construction contracts, boundary disputes, easement/access disputes and the recording and foreclosure of mechanic’s liens [please see links below]. We routinely litigate against large Denver firms or large in-house corporate legal departments and routinely prevail against them.

Bankruptcy/Creditors Rights:

We represent Chapter 7 Trustees, creditors and Chapter 11 debtors in bankruptcy proceedings. We specialize in bankruptcy litigation and representing medium-sized corporations in Chapter 11 bankruptcy cases. In recent bankruptcy litigation matters, our clients have been successful in opposing the motion of a Chapter 7 Trustee to extend the deadline to file a complaint to determine nondischargeability and dismissing multiple claims filed by a Chapter 7 Trustee for fraudulent transfers and civil conspiracy [please see links below]. We also recently completed our representation of a Chapter 11 debtor, TenderCare, Inc., by assisting it with the sale of its assets for a purchase price that will allow it to pay its creditors in full.

We represent small and medium-sized businesses with respect to all of their contractual and transactional issues. We not only assist clients with drafting contracts and agreements frequently used in their businesses but also represent them on large transactions such as the purchase or sale of their business or their real estate. Recent transactions in which we have represented clients include the purchase of a restaurant in Evergreen, Colorado, the sale of a holiday decorating business in Westminster, Colorado, the sale of commercial property in Syracuse, New York, and the wind down of an auto dealership in Carthage, Tennessee.
